Seglo Phone Acceptable Use Policy

This Acceptable Use Policy ("Policy") sets out how the Seglo Phone service — including its unlimited standard Australian calls, SMS and MMS — may and may not be used. It forms part of, and is incorporated into, the Seglo Phone Terms of Service (seglo.ai/phone/terms), and is referred to in the Critical Information Summary (seglo.ai/phone/cis). By using Seglo Phone, the Client and each of its Authorised Users agree to this Policy.

1. Unlimited, under fair use

1.1 The Seglo Phone monthly charge includes unlimited standard Australian voice calls, SMS and MMS under a fair-use basis. "Fair use" means ordinary, day-to-day business communication — the kind of calling and messaging a business does in the normal course of dealing with its own customers, staff and suppliers.

1.2 "Unlimited" is not a licence for unlimited volume of any kind. It is provided on the understanding that usage stays within normal business patterns. Usage that is abnormal in volume, velocity or pattern, or that is not genuine business communication, is outside fair use.

2. Prohibited use

2.1 The Client and its Authorised Users must not use, or permit the use of, Seglo Phone for:

  • (a) marketing campaigns, promotional broadcasts, or advertising sent to recipients generally rather than as part of an individual business conversation;
  • (b) bulk, mass or high-volume calling or messaging, including sending the same or similar message to many recipients;
  • (c) spam or any unsolicited commercial electronic message, or any message that contravenes the Spam Act 2003 (Cth) or the Do Not Call Register Act 2006 (Cth), including any message sent without the recipient's consent or without a working unsubscribe/opt-out facility;
  • (d) automated or machine-generated calling or messaging, auto-diallers, message blasting, or any sending that is not initiated by a human, except where a feature is expressly provided and supported by Seglo for that purpose;
  • (e) presenting any calling-line identity the Client is not authorised to use; or
  • (f) any unlawful, fraudulent, deceptive, abusive, or network-harming purpose.

2.2 Seglo Phone is a service for human business conversation. Transactional and service communications that Seglo expressly supports (for example, appointment confirmations and reminders, booking and account notifications, one-time codes, and voicemail or missed-call notifications) are permitted, provided they comply with applicable law and any usage limits Seglo notifies.

3. How this Policy is enforced

3.1 Seglo operates automated systems that monitor usage patterns, message velocity, volume, frequency and metadata — not the content of communications — to protect the platform and any telecommunications network and to enforce this Policy. This is the same traffic-shape monitoring described in the Terms of Service.

3.2 Where Seglo detects use that breaches this Policy, or usage that threatens the security, stability or integrity of any network, Seglo may apply a reasonable limit, suspend, or terminate the service, in accordance with clause 9 of the Terms of Service. Where necessary to prevent imminent harm, Seglo may act without prior notice; a suspension is a protective, temporary measure and Seglo will, where lawful and practicable, tell the Client the reason and what is required to restore the service.

3.3 A breach of this Policy is a material breach of the Terms of Service.

4. Relationship to the Terms

This Policy is the "Fair Use Policy" referred to in the Seglo Phone Terms of Service. If there is any inconsistency between this Policy and the Terms of Service, the Terms of Service prevail. Seglo may update this Policy from time to time on reasonable notice, in the same way it may vary the Terms.
